This document is a public offer (proposal) by the individual entrepreneur Ivan Dotsenko (the “Seller”) to enter into an agreement with a user of the Less Stress mobile app for Android installed from the RuStore app store (the “App”) for access to the extended features of the App (“Less Stress Plus”, “Plus”) on the terms set out below. This offer is made in accordance with Article 437(2) of the Civil Code of the Russian Federation.
In accordance with Article 438(3) of the Civil Code of the Russian Federation, this offer is accepted by payment: starting a subscription or making a one-time purchase in the App through RuStore Pay.
1. Parties
Seller: Ivan Dotsenko, individual entrepreneur, payer of the professional income tax (NPD). Taxpayer ID (INN) 236501590758, OGRNIP 326237500135529. Krasnodar, Russian Federation. Email: prodocik@gmail.com.
Buyer: an individual who uses the Less Stress app for Android installed from RuStore, is at least 18 years old or uses the App with the consent of a legal representative, and has started a subscription or made a purchase through RuStore Pay.
2. Subject matter
The Seller grants the Buyer access to Plus, the extended features of the App:
- eight additional breathing practices;
- longer sessions, up to 15 minutes, for rhythms where this is allowed; some practices have a lower maximum length.
All other features of the App are available free of charge, including Basic breathing (a five-second inhale and five-second exhale) with one-minute sessions, history and progress, reminders and voice guidance.
Plus is offered in one of the following options:
- Monthly («Месяц»): a 1-month subscription renewing automatically every month;
- Yearly («Год»): a 1-year subscription renewing automatically every year;
- Lifetime («Навсегда»): a one-time purchase with no subscription, no automatic renewal or charges, and no time limit, tied to the RuStore account used to make it.
3. Price and payment
Prices are shown on the payment screen in the App and in RuStore before the purchase is made. Prices are in Russian rubles and include applicable taxes.
Payment is made through RuStore Pay, the payment service of the RuStore app store, under its rules. Neither the Seller nor the App receives the Buyer’s bank card details. Practice history and preferences are stored on the Buyer’s device and in the Buyer’s own backup, if backup is turned on in the system; they are not transferred to the Seller and are not involved in the payment.
4. Automatic renewal and cancellation
A subscription renews automatically for a new period of the same length at the price in effect at the time of renewal until the Buyer cancels it.
The Buyer may cancel a subscription at any time before the next renewal date in the RuStore app: Profile → Subscriptions → Less Stress → Cancel subscription. Deleting the App does not cancel the subscription. After cancellation, Plus remains available until the end of the period already paid for.
The Lifetime purchase does not renew and does not need to be cancelled.
5. Provision of access
Plus is digital content with no physical medium. Access is enabled in the App once RuStore confirms the payment.
When Plus ends, the Buyer’s practice history is not deleted: Basic breathing and the saved history remain available, while the additional practices and longer sessions require Plus again.
6. Restoring a purchase
After reinstalling the App or switching to another device, access is restored with Restore purchases in the App’s You tab («Профиль» in Russian) or with Restore on the Plus screen. Restoring requires the same RuStore account that was used for the purchase and the RuStore app installed on the device.
7. Refunds
Refunds for a subscription or a one-time purchase are made under the RuStore rules and in accordance with Russian Federation Law No. 2300-1 of 7 February 1992 “On Consumer Rights Protection”.
Turning off renewal of a subscription for future periods is done by the Buyer in the RuStore app (Section 4) and does not require contacting the Seller.
If Plus is not enabled after payment, or the Buyer wishes to request a refund, the following procedure applies:
7.1. The Buyer uses Restore purchases in the App.
7.2. If that does not help, the Buyer writes to prodocik@gmail.com, stating the date and option of the purchase and, if available, the RuStore order number or purchase identifier.
7.3. The Seller reviews the request within 10 calendar days of receipt and communicates the decision; any refund is made through RuStore.
8. Liability and health
The Seller warrants that Plus matches the description in Section 2 and on the payment screen at the time of purchase. The Seller is not liable for the inability to use Plus for reasons beyond the Seller’s control, including no internet connection during payment or restoration, operating system or device failures, or changes to the RuStore rules. This provision applies unless consumer protection legislation provides otherwise.
The App supports general wellbeing. It is not a medical device within the meaning of Federal Law No. 323-FZ of 21 November 2011 “On the Fundamentals of Health Protection of Citizens in the Russian Federation”, is not intended to diagnose, prevent or treat any disease and does not replace advice from a doctor. The Buyer performs the breathing exercises at a comfortable pace and stops if feeling dizzy, short of breath or uncomfortable; anyone with a health condition is advised to consult a doctor before starting.
9. Personal data
Data processing is described in the Privacy Policy (Russian version). Payment data is processed by RuStore, not by the Seller.
10. Term and amendments
This offer is effective from the date of publication until withdrawn. The current version is published at https://less-stress-privacy.pages.dev/en/offer/ (Russian version: https://less-stress-privacy.pages.dev/offer/).
The Seller may amend this offer; a new version takes effect upon publication. Agreements already concluded are governed by the version in effect at the time of acceptance, and each subscription renewal is governed by the version in effect at the time of that renewal.
11. Governing law
The agreement is governed by the laws of the Russian Federation. Disputes not resolved by negotiation are referred to a court in accordance with consumer protection legislation.
